Resumo

As recentes inovações, ligadas às indústrias de computação e eletrônica, vêm colocando em evidência certas motivações (legais e deliberadas) para o reforço do sistema de direitos autorais na indústria fonográfica. Este artigo analisa os efeitos de um conjunto de inovações sobre as formas de proteção de criações artísticas. O argumento básico está em considerar que, quando a imitação é fácil, os lucros da inovação podem advir de certos ativos complementares, mais do que do sistema de propriedade intelectual. O foco está nas relações entre inovações, regime de apropriabilidade, ativos complementares e desempenho comportamental da indústria. Afirma-se aqui que, sendo o conteúdo (as canções) do formato digital da música (recurso de computação) de sua propriedade (direitos autorais), a indústria (fonográfica) acaba por se beneficiar do desenvolvimento da inovação se o know-how em questão for utilizado (mediante integração vertical ou acordos contratuais) em conjunto com outras capacidades ou ativos, na sua comercialização.
