Abstract

The article analyzes the importance of patents for Brazilian universities with reference to the literature on the intellectual property right theory. It deals initially with theoretical questions regarding patents. Subsequently, the paper shows the current legislations of Brazil, the USA and Germany as well as empirical information on university patents. Furthermore, the article refers to the impact of these patents on universities and on the private sector. Finally, it makes the following suggestions: i) improvement of infrastructures on patent information and transfer to the market; ii) major inclusion of researchers and professors in commercial exploitation strategies; iii) orientation of research activities to the market demand; iv) cooperation with private sector in research fields with intensive R&D; v) granting of exclusive licenses to private businesses; and vi) optimization of patent commercialization installing flexible systems of incentives and networks.
